Abstract

Advances in science reproductive and technology reached levels never before imagined, providing the men and women unable to procreate by natural means the possibility to realize the dream of have a kid, however, the absence of a specific law in Brazil has led to abuses and moments of legal uncertainty. At the same time, the changes in the concept of family in Brazil led to a free format, where procreation is not more it’s function, but a mean to establish or increase the family entity and whose planning and exercise of reproductive rights fit exclusively to those who compose it.  This article aims to demonstrate the relationship between reproductive rights, family planning and assisted human reproduction and analyse the rules governing this type of medical treatment in Brazilian territory today.
