O bebé Gammy e a gestação de substituição em Portugal

O artigo equaciona o sentido e utilidade da recente admissão da gestação de substituição em Portugal, numa altura em que a comunidade internacional reclama a sua regulamentação transnacional, a fim de evitar o chamado “turismo reprodutivo” e a União Europeia apela à pura e simples proibição de tais práticas. Pretendemos verificar os pontos relevantes da alteração introduzida pela Lei n.º Lei 17/2016, de 17.6, indagando a bondade jurídica das soluções encontradas pela ponderação do que de essencial aí se consigna quanto às vulgarmente conhecidas barrigas de aluguer, concluindo por uma precipitação legislativa com importantes consequências jurídicas (ausência de regulamentação completa), mas também sociais (turismo reprodutivo).
